Establishing paternity is done when the father agrees to have his name on the child’s birth certificate, by declaring parentage, and having the child’s birth records corrected, or there may be cases when the court will have to order genetic testing to establish paternity. In these cases, both parties often need to have a skilled family law attorney.
Keep in mind, once parentage has been established, the father has the right to visitation, and may be required to pay child support. This becomes complex; unlike a married couple, the mother may have no idea about the father’s current financial situation, or other matters which could impact the child.
